These Terms and Conditions apply to purchases made by consumers through wild-animals.nl.

Please read them carefully before placing an order. By placing an order through our website, you agree to these Terms and Conditions.

Nothing in these Terms affects any mandatory consumer rights that apply to you under applicable law.

In these Terms, “Wild Animals”, “we”, “us” and “our” refer to Wild Animals B.V.

“You” and “your” refer to the consumer placing an order through our website.

2. Consumer and wholesale purchases

These Terms are intended for purchases made by consumers for private use.

Wild Animals also supplies wholesale customers through our website using a separate wholesale portal operated through SparkLayer. Business-to-business purchases may be subject to separate wholesale terms and are not governed by consumer rights that apply only to private customers.

We reserve the right to refuse or cancel an order placed through the consumer store where we reasonably believe that the order is primarily intended for commercial resale. Where appropriate, we may direct trade customers to our wholesale service instead.

3. Our products

We make reasonable efforts to ensure that product descriptions, measurements, photographs, colours, materials and other information shown on our website are accurate.

However, some variation is normal.

Certain Wild Animals products, including knitted products, rugs, prints and other items, may be handmade, individually produced or made using materials or processes that naturally result in differences between individual items.

Minor differences in colour, texture, dimensions, finish, positioning, print reproduction or other characteristics do not necessarily mean that a product is defective.

Colours may also appear differently depending on the screen, device or display settings used to view our website.

Nothing in this section affects your rights where a product is faulty, materially different from its description or otherwise does not conform to the contract.

4. Limited-edition prints

Some Wild Animals prints are produced after an order is placed and may be individually numbered and signed.

Unless explicitly stated otherwise on the relevant product page, these prints are not personalised or made to specifications chosen by the individual customer.

The fact that a print is produced, numbered or signed after an order is placed does not by itself remove any statutory right of withdrawal that would otherwise apply.

5. Availability

All products are subject to availability.

Although we use inventory systems to manage stock, errors can occasionally occur and an item shown as available may no longer be available when we process your order.

If we cannot supply an item you have ordered, we may cancel the affected item or order. Where payment has already been taken, we will refund the amount paid for the unavailable item, including any associated amount that must be refunded under applicable law.

We may also contact you to offer an alternative, but you are not required to accept one.

6. Quantity limits

We may apply reasonable quantity limits to particular products, releases, editions, promotions or customers.

Where a specific limit applies, we will normally state this on the relevant product page or as part of the applicable promotion.

We may refuse or cancel orders which reasonably appear to be intended to circumvent a stated quantity limit, including multiple related orders placed by the same person.

7. Prices

Prices displayed on wild-animals.nl may vary depending on the customer’s market.

We use Shopify Markets and related market-specific pricing settings to determine pricing in different countries and regions. Prices in one market may therefore differ from prices in another market and may not simply reflect a direct currency conversion.

The price applicable to your order is the price displayed to you at checkout before you place the order.

Netherlands and European Union

For customers in the Netherlands and other applicable EU markets, displayed consumer prices include applicable VAT.

United Kingdom, United States, Switzerland and other international markets

For customers in the United Kingdom, United States, Switzerland and other non-EU markets served by our international pricing arrangements, prices are adjusted by market to account for applicable taxes, duties and import costs.

Where we state that an order is shipped Delivered Duty Paid (DDP), the price charged by Wild Animals includes applicable import duties and taxes associated with delivery of that order, and you should not be required to pay additional import duties or taxes to the carrier upon delivery.

If you are nevertheless asked by a carrier or customs authority to pay an unexpected import charge on a DDP shipment, please contact us before making payment where reasonably possible.

8. Pricing errors

We take reasonable care to ensure that prices are accurate, but errors can occur.

If a product is listed at an obviously incorrect price because of a technical, administrative or other genuine error, we are not obliged to supply the product at that incorrect price where you knew, or could reasonably have recognised, that the price was an error.

If we identify such an error before accepting your order, we may cancel the order and refund any payment already made.

Where appropriate, we may contact you and give you the opportunity to place a new order at the correct price.

9. Promotions and discount codes

From time to time we may offer promotional prices, discount codes or other offers.

Unless otherwise stated:

  • promotions may be limited to particular products, customers, countries, markets or periods;
  • discount codes have no cash value;
  • discount codes may not be combined with other discounts or promotions;
  • a promotion may be subject to reasonable quantity limits;
  • a discount must be applied at checkout in accordance with the terms of the promotion; and
  • expired offers or codes do not need to be honoured.

We may withdraw, correct or cancel a promotion where it has been published or configured in error, provided that doing so does not affect rights that have already arisen under an accepted contract.

Nothing in a promotion limits your statutory consumer rights.

10. Placing an order

Our website will allow you to review your order before submitting it.

You are responsible for checking that the information you provide, including your products, quantities, delivery address and contact details, is correct before placing the order.

When you place an order:

  1. you submit an offer to purchase the products in your basket;
  2. we may authorise or collect payment;
  3. we send you an order acknowledgement confirming that we have received your order; and
  4. we review and process the order.

An order acknowledgement does not mean that we have accepted your order.

11. When a contract is formed

A binding sales contract is formed when we accept your order by dispatching the goods and sending you confirmation that the order has been dispatched.

Until that point, we may decline an order for legitimate reasons, including:

  • an item being unavailable;
  • an obvious pricing or product-information error;
  • inability to authorise payment;
  • reasonable concerns about fraud or misuse;
  • an order exceeding a stated quantity restriction;
  • an order reasonably appearing to be intended for unauthorised commercial resale; or
  • our being unable to deliver to the address or market provided.

If we decline an order after payment has already been collected, we will refund the amount due to you.

12. Payment

We currently accept payment using supported methods which may include:

  • Bancontact;
  • BLIK;
  • iDEAL | Wero;
  • Klarna;
  • MobilePay;
  • Apple Pay;
  • UnionPay;
  • Maestro;
  • Mastercard;
  • Visa; and
  • Shop Pay.

The payment methods available to you may vary depending on your country, currency, device or other checkout circumstances.

Payments may be processed by third-party payment providers. Their own terms may also apply to their payment services.

Where you choose a payment service such as Klarna, any separate credit, deferred-payment or financing arrangement between you and that payment provider may also be subject to that provider’s terms.

13. Delivery

Available delivery methods, shipping charges and estimated delivery times are shown on our website and/or during checkout.

Delivery times are estimates unless we expressly agree otherwise.

We will deliver your order within the period agreed with you or, where no other period has been agreed, within the period required by applicable consumer law.

If we are unable to deliver within a legally required or agreed period, you may have the right to give us an additional reasonable period for delivery and, where applicable, cancel the contract and receive a refund.

14. Risk during delivery

Wild Animals remains responsible for the goods during normal delivery until you, or a third party identified by you other than the carrier, takes physical possession of them.

If you independently arrange for a carrier that was not offered by Wild Animals, different statutory rules regarding transfer of risk may apply.

If your parcel appears to be lost, damaged in transit or incorrectly delivered, please contact us at shop@wild-animals.nl.

We will handle the matter with the carrier as appropriate. Your statutory rights against Wild Animals are not dependent on whether we successfully recover compensation from the carrier.

15. Delivery addresses and failed delivery

You are responsible for providing a complete and accurate delivery address when placing your order.

If an order cannot be delivered because the address supplied by you was incorrect or incomplete, or because you failed to collect or accept a delivery despite reasonable delivery attempts, Wild Animals is not responsible for additional costs resulting directly from that error or failure.

If the parcel is returned to us and you request reshipment, we may require you to pay the reasonable additional cost of reshipping the order.

This does not apply where the delivery problem was caused by Wild Animals, our systems or a carrier acting on our behalf.

16. Right of withdrawal

If you are a consumer purchasing online, you will generally have a statutory right to withdraw from your purchase without giving a reason.

For most goods, the withdrawal period is 14 calendar days from the day on which you, or a third party nominated by you other than the carrier, receives the goods.

Where one order contains multiple goods delivered separately, the withdrawal period will generally run from receipt of the final item where required by applicable law.

You must notify us of your decision to withdraw before the withdrawal period expires.

You may do this by making a clear statement that you wish to withdraw from the contract.

If your order has not yet been dispatched, you can request cancellation using our Cancel Order page. If your order has already been dispatched or delivered, please use our Returns Portal to exercise your withdrawal and return rights.

You do not need to give a reason for exercising a statutory right of withdrawal.

17. Returning goods after withdrawal

After notifying us that you are exercising your right of withdrawal, you must return the relevant goods within the period required by applicable law.

Unless the goods are faulty, incorrect or we have agreed otherwise, you are normally responsible for the direct cost of returning goods following a change-of-mind withdrawal.

You may handle and inspect the goods only to the extent reasonably necessary to establish their nature, characteristics and functioning, in the same way that you would reasonably be able to inspect them in a physical store.

We may be entitled to make a lawful deduction from a refund where goods have lost value because they have been handled beyond what was reasonably necessary for that inspection.

Further practical instructions may be set out in our Returns Policy.

The Returns Policy does not limit your statutory rights.

18. Refunds following withdrawal

Where you validly exercise your statutory right of withdrawal, we will refund payments that must be refunded under applicable law.

Where the entire order is withdrawn, this generally includes the cost of our least expensive standard delivery method offered for that order.

If you selected a more expensive delivery method than our standard delivery option, we do not have to reimburse the additional cost of that upgrade where the law allows us not to do so.

We will make the refund within the period required by law and may, where permitted, withhold reimbursement until we have received the returned goods or you have supplied evidence that you have sent them back, whichever occurs first.

Refunds will normally be made using the same payment method used for the original transaction unless another method is expressly agreed and doing so does not result in additional cost to you.

19. Exceptions to the right of withdrawal

The statutory right of withdrawal may not apply to certain categories of goods where an exception is recognised by applicable consumer law.

If such an exception applies to a particular Wild Animals product, we will make this clear before you purchase it.

Wild Animals does not treat a standard limited-edition print as exempt from the right of withdrawal merely because it is printed, numbered or signed after your order is placed.

20. Faulty, damaged or incorrect products

We are responsible for supplying products that conform to the contract and meet the standards required by applicable consumer law.

If an item is faulty, damaged, incorrectly supplied or otherwise does not conform to the contract, please contact:

Please provide your order number and enough information for us to understand the issue. Photographs may be useful where appropriate but will not be demanded where they are unnecessary or unreasonable.

Depending on the circumstances and your statutory rights, an appropriate remedy may include repair, replacement, price reduction or refund.

Where Wild Animals is legally responsible for a faulty, damaged or incorrectly supplied product, we will not require you to bear costs that the law requires us to bear.

21. Statutory guarantee

Consumers are entitled to the statutory legal guarantee that goods must conform to the contract and be of the quality and durability that may reasonably be expected in the circumstances.

Wild Animals does not currently provide an additional commercial warranty beyond those statutory rights.

The absence of an additional commercial warranty does not limit your legal rights in relation to defective or non-conforming goods.

22. Complaints

If you have a complaint about a product, an order or our service, please contact:

Please include your order number where relevant and a clear description of the issue.

We aim to acknowledge and deal with complaints promptly and, where reasonably possible, provide a substantive response within 14 days.

Wild Animals B.V. is not currently affiliated with an external consumer complaints board or alternative dispute-resolution body.

Nothing in this section prevents you from exercising any statutory right or remedy available to you.

23. Intellectual property

Unless otherwise stated, all intellectual property rights in the Wild Animals website and Wild Animals materials are owned by Wild Animals B.V.

This includes, where applicable:

  • trademarks and brand names;
  • logos;
  • artwork;
  • illustrations;
  • graphics;
  • prints and designs;
  • photographs;
  • product designs;
  • written copy;
  • website design; and
  • other original content.

Purchasing a Wild Animals product does not transfer any copyright, trademark or other intellectual property right in the design, artwork or content embodied in that product.

You may use the website and products for normal personal purposes.

You may not reproduce, distribute, commercially exploit, modify, publish or create commercial derivative works from our protected content without our prior permission, except where applicable law allows you to do so.

24. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms limits:

  • mandatory consumer rights;
  • liability for fraud or fraudulent misrepresentation;
  • liability for death or personal injury where such liability cannot lawfully be excluded; or
  • any other liability that cannot legally be limited or excluded.

Wild Animals is not responsible for losses that were not reasonably foreseeable when the contract was made or for losses arising from circumstances for which we are not legally responsible.

Because these Terms apply to consumers, we are not responsible for business losses such as loss of profit, revenue, business opportunity or commercial goodwill arising from a consumer purchase.

25. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control to the extent permitted by law.

Such events may include significant transport disruption, strikes, natural disasters, governmental measures, customs disruption, war, civil unrest, widespread telecommunications failures, major technical infrastructure failure or similar events that we could not reasonably prevent or overcome.

Where such an event affects an order, we will take reasonable steps to minimise its impact and will continue to respect any mandatory rights you have under consumer law.

26. Personal data

We process personal data in connection with orders and use of our website.

Information about how we collect, use, share and protect personal information is provided separately in our Privacy Policy.

Our Privacy Policy does not form part of the contractual terms of sale except where applicable law provides otherwise.

27. Other website policies

Our website may contain separate policies covering matters including:

  • shipping;
  • returns and refunds;
  • privacy; and
  • cookies.

These policies should be read together with these Terms where relevant.

If there is a conflict between a separate customer policy and a mandatory consumer right, the mandatory consumer right takes precedence.

28. Changes to these Terms

We may update these Terms from time to time, for example because our business, services, systems or legal obligations change.

The Terms that apply to your purchase are generally the version in force when you placed your order.

A later change to these Terms will not retrospectively remove rights you already have under an existing contract.

The current version and its latest revision date will be published on our website.

29. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally possible.

The remaining provisions will continue to apply.

30. No waiver

If we do not immediately enforce a provision of these Terms, that does not mean that we waive our right to enforce it later.

31. Governing law

These Terms and contracts made under them are governed by the laws of the Netherlands.

If you are a consumer living outside the Netherlands, this choice of law does not deprive you of any mandatory consumer protections that apply to you under the law of your country of residence where those protections cannot lawfully be excluded.

32. Disputes and jurisdiction

We encourage you to contact us first if you have a dispute so that we have an opportunity to resolve it.

Any dispute may be submitted to the competent courts in accordance with applicable law.

Nothing in these Terms restricts any mandatory right you may have as a consumer to bring proceedings in another competent court, including a court in your country of residence where applicable law gives you that right.

33. Language

These Terms are provided in English.

If we provide a translation in the future, the English version may be used as the reference version to the extent permitted by applicable mandatory law.

Nothing in this clause restricts rights that consumers may have regarding the provision of legally required information.
